Three-judge panel of the U.S. Court of Appeals for the D.C. Circuit unanimous ruling against TikTok comes on heels of AmFree amicus brief supporting the ban

Washington, D.C. –Today, the American Free Enterprise Chamber of Commerce (AmFree) issued the following statement after the U.S. Court of Appeals for the District of Columbia Circuit unanimously upheld the Protecting Americans from Foreign Adversary Applications Act forcing TikTok to divest from the ownership and control of the Chinese Communist Party (CCP) and other foreign adversaries, if TikTok wants to continue operating in the United States:
“Today’s ruling is a step forward for American national security and a major setback for the CCP’s efforts to surveil our citizens and steal our data in their quest for geopolitical dominance,” said Machalagh Carr, Director of AmFree’s Center for Legal Action (CLA). “Mandatory divestment by the CCP is entirely consistent with the First Amendment, which does not protect attempts by foreign adversaries to surveil Americans or covertly manipulate American communication platforms, plain and simple. Divestment from the CCP is the only way to stop the glaring national security threat posed by TikTok’s continued presence in the United States.”
