In January, AmFree took legal action challenging the constitutionality of the broader law empowering the EPA’s ability to assess a tax on oil and natural gas producers

Washington D.C. –  Today, the American Free Enterprise Chamber of Commerce (AmFree Chamber) praised President Donald Trump for signing a bipartisan Congressional Review Act (CRA) resolution repealing the Biden administration EPA’s rule purporting to implement the Waste Emissions Charge (WEC) tax on methane included in the Inflation Reduction Act (IRA):

“Getting this onerous rule off the books is a major step toward restoring American energy dominance, and we appreciate the speed with which bipartisan members of Congress and the Trump Administration acted,” said Gentry Collins, Chief Executive Officer of the AmFree Chamber. “The Biden Administration’s ceaseless assault on our domestic energy producers knew no limits, and this rule would have hammered producers and consumers alike. While the CRA was an important first step, now Congress must repeal the unconstitutional broader law that continues to create uncertainty as American energy producers remain subject to a taxing regime that doesn’t even let them know how to comply.”

In January, AmFree Chamber, along with the Michigan Oil and Gas Association, filed two lawsuits: one in the U.S Court of Appeals for the D.C. Circuit challenging EPA’s implementation of the rule, and a second in the U.S. District Court for the Western District of Michigan challenging the statute itself as unconstitutional.  

AmFree also authored an op-ed in the Detroit News on the importance of the lawsuit and the economic threat of the tax.
