AmFree files motion to intervene against lawsuits brought by environmental groups and progressive states; pledges to fight special-interest groups’ efforts to hijack this decisive victory for free enterprise, common sense and economic growth
Washington D.C. – Today, the American Free Enterprise Chamber of Commerce (AmFree Chamber), joined by a powerful coalition of business interests, filed a motion to intervene in the U.S. Court of Appeals for the D.C. Circuit defending the Trump Administration’s historic repeal of the Environmental Protection Agency (EPA) 2009 Greenhouse Gas Endangerment Finding. The filing comes in response to lawsuits brought by environmental groups and certain states seeking to overturn EPA Administrator Lee Zeldin’s final rule that rescinded the Obama-era finding and repealed all tailpipe emissions rules for cars and trucks. EPA’s final rule permanently eliminates the Biden administration’s EV mandate, which would have forced more than two thirds of new cars and trucks to be electric and cost Americans trillions of dollars.
“By intervening, we proudly stand shoulder-to-shoulder with President Trump and Administrator Zeldin in their bold effort to end the EV mandate, protect free enterprise, American jobs, and the American automobile from activist litigation,” said AmFree Chamber CEO Gentry Collins. “EPA’s job is to protect human health and welfare from air pollution. It’s not a blank check for bureaucrats to invent new climate policies like banning the internal combustion engine. The Endangerment Finding was a left-wing regulatory power grab that cost American families and businesses trillions of dollars. EV mandates are bad policy and opposed by most Americans. AmFree Chamber and our coalition partners will not allow special-interest groups to undo this decisive victory, and we are committed to ensuring that future administrations cannot weaponize the EPA against the very people it is supposed to serve.”
In September 2025, AmFree Chamber submitted extensive comments supporting the repeal, led coalitions defending other Trump deregulatory actions, and will continue to aggressively defend this rulemaking in court all the way to the Supreme Court if necessary.
Groups joining AmFree Chamber’s motion to intervene include the National Federation of Independent Business and several state corn grower associations.
